Welcome to Makefy! These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using Makefy, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

2. Description of Service

Makefy is an AI-powered analytics and SEO tool that provides YouTube creators with:

• SEO optimization tools for video titles, descriptions, and tags
• AI-generated B-roll suggestions and copyright-free video clips
• YouTube channel analytics and insights
• Content strategy recommendations
• Multi-channel management (Pro plan)

Important: Makefy is an analytics and recommendation tool only. Makefy does not control, manage, or operate your YouTube channel. You remain fully responsible for all content, actions, and decisions related to your YouTube channel. Makefy provides insights, analytics, and suggestions to help you make informed decisions, but you are solely responsible for all content you publish on YouTube and for ensuring compliance with YouTube's Terms of Service and Community Guidelines.

3. Account Registration

To access certain features of our Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account
• You must be at least 13 years old to use our Service

4. Subscription Plans and Pricing

4.1 Free Plan

• 10 SEO generations per month
• 20 video generations per month
• Access to AI B-roll finder
• Community support
• No credit card required

4.2 Hobby Plan (€9/month)

• 50 SEO generations per month
• 100 video generations per month
• YouTube channel linking
• Basic analytics dashboard
• Priority support

4.3 Pro Plan (€29/month)

• Unlimited SEO and video generations
• Multi-channel management
• Advanced analytics + keyword tracking
• Team access (2-3 members)
• Dedicated support

4.4 Payment Terms

• All prices are in Euros (EUR)
• Subscriptions are billed monthly in advance
• All fees are non-refundable except as required by law
• We reserve the right to change our pricing with 30 days notice

5. Cancellation and Refunds

• You may cancel your subscription at any time from your account settings
• Cancellations take effect at the end of your current billing period
• You will continue to have access to paid features until the end of your billing cycle
• No refunds are provided for partial months or unused credits
• If you cancel, your account will revert to the Free plan

6. Acceptable Use Policy

You agree NOT to use our Service to:

• Violate any laws or regulations
• Violate YouTube's Terms of Service, Community Guidelines, or any other YouTube policies
• Infringe on intellectual property rights of others
• Upload malicious code or viruses
• Attempt to gain unauthorized access to our systems or YouTube APIs
• Resell or redistribute our Service without permission
• Use automated means to access the Service (except as specifically allowed)
• Generate spam or misleading content
• Harass, abuse, or harm other users
• Use the Service in any way that could damage, disable, or impair YouTube's services or violate Google's API Services User Data Policy

7. Content and Copyright

7.1 Your Content

You retain all rights to the content you create using our Service. By using Makefy, you grant us a limited license to process and analyze your content to provide our services.

7.2 B-roll Content

All B-roll clips provided through Makefy are sourced from copyright-free libraries including Pexels, Pixabay, and similar services. While these clips are generally free to use:

• You are responsible for verifying the license of any clip before commercial use
• We provide source attribution with each download
• Makefy is not liable for copyright claims arising from your use of provided clips

7.3 AI-Generated Content

AI-generated titles, descriptions, and tags are provided as suggestions. You are responsible for reviewing and ensuring all content complies with YouTube's policies and applicable laws.

8. YouTube API Services and Google OAuth

Makefy uses YouTube API Services and Google OAuth to connect to your YouTube channel. By using our Service and connecting your YouTube channel, you agree to be bound by the YouTube Terms of Service and Google Privacy Policy.

Read-Only Access: Makefy uses only read-only OAuth scopes (https://www.googleapis.com/auth/youtube.readonly and https://www.googleapis.com/auth/yt-analytics.readonly) to access your YouTube data. Makefy never posts, edits, deletes, or uploads content to your YouTube channel on your behalf. Makefy only reads data from your YouTube channel to provide analytics, insights, and recommendations.

Your Responsibility: You are solely responsible for your YouTube channel, including all content you publish, compliance with YouTube's Terms of Service and Community Guidelines, and any actions taken on your channel. Makefy does not control or manage your YouTube channel and is not responsible for any content, decisions, or actions you take on YouTube.

Disconnecting YouTube: You can disconnect your YouTube channel from Makefy at any time through your account settings. When you disconnect, we immediately revoke access to your OAuth tokens and stop collecting data from YouTube APIs. All cached data will be deleted within 30 days.

Makefy's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

9. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to our Service. We may:

• Perform scheduled maintenance with advance notice
• Experience temporary outages due to technical issues
• Modify or discontinue features with reasonable notice

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKEFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

YouTube-Related Liability: Makefy is not responsible for any actions taken by YouTube, Google, or any third party regarding your YouTube channel, including but not limited to: demonetization, content strikes, channel suspensions, account terminations, changes to YouTube policies, API limitations or restrictions, or any other actions that may affect your YouTube channel or revenue. You acknowledge that Makefy has no control over YouTube's operations, policies, or decisions, and you use our Service at your own risk.

Makefy provides analytics and recommendations only. Any decisions you make based on Makefy's insights, recommendations, or analytics are your sole responsibility. Makefy is not liable for any losses, damages, or negative consequences resulting from your use of our Service or any actions you take on your YouTube channel.

11. Disclaimer of Warranties

OUR SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Indemnification

You agree to indemnify and hold harmless Makefy, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our Service or violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct we deem harmful to our Service or other users. Upon termination:

• Your access to paid features will cease immediately
• We may delete your account data after 30 days
• No refunds will be provided for remaining subscription periods

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Italy.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by:

• Posting the new Terms on this page
• Updating the "Last updated" date
• Sending an email notification to registered users

Your continued use of the Service after changes constitutes acceptance of the new Terms.
